Every
effort is made using laboratory guidance to insure that
sampling is done properly as indicated by the EPA.
The parties for whom these tests are done agree that
under no circumstances will the Company be held responsible
for the cost of any follow-up testing required if the test
result is positive.
This agreement is between the Company and the Client
named on the report page #1. In consideration of the fees and
limitations of liability to the fullest extent the law allows,
the Company agrees to conduct tests, or sampling using
industry standards. The
results of the Water Tests will come from an EPA-approved
laboratory.
Any
water tests done at the property by the Inspector are done as
a guide, their accuracy cannot be guaranteed, if a binding
result is needed, Client will need to arrange with the
Inspector for laboratory sampling and analysis.
It is also understood and agreed by the parties for
whom these tests are performed, that should the Company, its
employees or agents be found liable for any loss or damages
arising from the failure to perform any of its obligations,
then the liability of the Company, its employees or agents
shall be limited to the sum equal to the amount of the fee
paid for the test or report.
